Terms of Service

These Terms govern the use of this website and the purchase of pieces and services from JB Estúdio Criativo LTDA, CNPJ 62.200.203/0001-89, a Brazilian company based in Curitiba, State of Paraná (“JB Estúdio,” “we,” “us”). By browsing, creating an account, or placing an order, you confirm that you have read, understood, and agree to these terms.

1. What we sell

JB Estúdio produces large-scale handcrafted floral sculptures and develops made-to-order scenic design projects. Each piece is made by hand, one at a time, in organza, Italian crepe paper, Premium EVA foam, heavyweight cardstock, and specialty materials.

Because they are handcrafted, pieces show natural variations in finish, drape, and tone from one to another. Website images are representative; color differences may occur due to screen calibration and photography lighting. These variations are a feature of handmade work, not a defect.

2. Who can buy

You must be at least 18 years old and have full legal capacity, or act through a legal representative. By purchasing on behalf of a company, you confirm you're authorized to do so.

We sell to buyers in Brazil and other countries. It's the buyer's responsibility to check whether the product can be legally imported into the destination country and what charges apply to that import, as described in our Shipping Policy.

3. Account and registration

You are responsible for the accuracy of the information you provide and for safeguarding your login credentials. Notify us immediately of any unauthorized use of your account. We may suspend or close accounts with false information or that are used fraudulently.

4. Orders and confirmation

Placing an order is a purchase proposal. The contract is formed once JB Estúdio confirms payment approval. We may decline or cancel orders, with a full refund, in cases of material unavailability, suspected fraud, an obvious pricing or description error, a legal restriction on export or import to the destination, or a technical inability to produce the requested customization.

5. Prices, currency, and payment

Prices are set in Brazilian reais (R$) for deliveries within Brazil and US dollars (USD) for international deliveries. If the website displays prices in your local currency, this is an approximate conversion shown for convenience: the charge is processed according to your payment provider's rules, and the final amount charged may vary due to the exchange rate and your bank's or card issuer's fees.

Prices may change at any time, without affecting orders already confirmed. The total amount — product, shipping, and any add-ons — is shown before checkout is completed. Import taxes and duties charged in the destination country are not included and are the buyer's responsibility, as described in our Shipping Policy.

We accept the payment methods shown at checkout, processed by external providers and subject to approval by the card issuer or financial institution.

6. Customization, briefing, and approval

Customized pieces — in color, height, quantity, or finish — depend on specifications agreed in writing before production begins, by email or messaging app. Production only starts once the final specifications are confirmed and payment is approved.

Approving the specifications is the point at which the order becomes irreversible, since from that moment materials are cut and the piece begins being sculpted specifically for you. Review color, height, proportions, and finish carefully before approving, and request any references or samples you need — cancellation is free and unrestricted as long as production hasn't started.

Changes requested after production has started may involve additional cost and a new timeline, always communicated and approved in writing before being carried out.

7. Timelines

Production and transit times are described in our Shipping Policy. Timelines given are estimates in business days in Brazil, where the pieces are made, and may be affected by events beyond our reasonable control — strikes, carrier failures, customs holds, natural disasters, unavailability of imported materials, and other force majeure events. In these situations, we'll notify you as soon as possible and agree on a new date or a cancellation with a refund.

8. Returns and cancellations

Every piece is made to measure, exclusively for each customer. You may cancel your order at no cost and without justification until you approve the specifications and authorize production to begin. After that approval, the order can no longer be cancelled for a simple change of mind, since the piece is made specifically for you and cannot be reused or resold.

This does not affect your rights in the case of a manufacturing defect or shipping damage. The full terms, including the rules that apply to international orders, are described in our Return & Refund Policy, which forms part of these Terms.

9. Scenic design projects under contract

Installations, panels, scenic designs, and made-to-measure projects developed from a briefing are contracted through a commercial proposal or a specific contract, with its own terms for scope, schedule, payment, cancellation, and liability. In case of any conflict, the signed contract prevails over these Terms for that project.

10. Intellectual property

All content on this website — text, photographs, videos, brand, and visual identity — and the designs of the pieces belong to JB Estúdio Criativo LTDA and Jacqueline Benevides, protected under Brazilian copyright law (Law No. 9.610/1998), industrial property law, and the international treaties Brazil is a signatory to, including the Berne Convention.

Purchasing a piece transfers ownership of the physical object, not the copyright to the work. Reproducing, copying, mass-producing, or using the designs for commercial production is prohibited, as is using website images without prior written authorization.

Unless requested otherwise in writing, JB Estúdio may photograph, film, and feature in its portfolio and on its social media the pieces and projects it produces, while safeguarding the customer's personal data.

11. Use of the website

You agree not to use the website for unlawful purposes, not to attempt to access restricted areas, not to use bots or automated scraping of content, and not to engage in acts that compromise the platform's security or availability.

12. Links and third-party services

This website may contain links to third-party websites and integrates external payment, logistics, and social media services. We have no control over these services and are not responsible for their content, practices, or privacy policies.

13. Limitation of liability

We are liable for direct damages arising from the products and services we provide, within the limits of applicable law. We are not liable for damages arising from improper use of the pieces, storage that does not follow our care instructions, installation carried out by third parties, customs holds in the destination country, or temporary website unavailability.

14. Privacy

The handling of personal data is governed by our Privacy Policy, which forms part of these Terms.

15. Changes to these Terms

We may change these Terms at any time. The version in effect is the one published on this page. Orders already confirmed remain governed by the version in effect on the date of confirmation.

16. Language of this page

This website is published in more than one language. Translations are provided to make it easier to read. In case of any discrepancy in interpretation between versions, the Brazilian Portuguese version prevails, except where the law of the buyer's country requires otherwise.

17. Governing law and jurisdiction

These Terms are governed by the laws of Brazil. The courts of Curitiba, State of Paraná, Brazil, have jurisdiction to resolve disputes.

This choice does not remove the mandatory consumer protections under the laws of the buyer's country of residence, where such laws so require, nor the buyer's right, in Brazil, to bring an action in the court of their own domicile, in accordance with the Brazilian Consumer Protection Code.
